Eligibility: The get to a better STATE™ Promotion (the “Sweepstakes”) is open only to legal residents of Arizona, Colorado, New Mexico, Nevada, Utah, and Wyoming, who are at least eighteen (18) years of age at the time of entry. Current employees, officers, directors, representatives of State Farm Mutual Automobile Insurance Companies (the “Sponsor”), its parent company, State Farm independent contractor insurance and financial services agents, affiliates, subsidiaries, advertising & promotion agencies, sweepstakes administrators and members of such employees’ immediate families, defined as spouses, parents, children, siblings (whether such family members are biological, adoptive, step or in-law) and their respective spouses, and those living in the same household of such employees are not eligible to enter or win. The Sweepstakes is subject to all applicable federal, state and local laws and regulations of the States of Arizona, Colorado, New Mexico, Nevada, Utah, and Wyoming, and is void outside of such states and where prohibited by law. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s and “Administrator’s” (defined in Paragraph 3 below) decisions, which are final, conclusive and binding in all matters related to the Sweepstakes. By entering, you understand that you are providing your information to the Sponsor and not Facebook®. Sponsor: State Farm Mutual Automobile Insurance Company, One State Farm Plaza, Bloomington, IL 61710 (the “Sponsor”). 3. Administrator: AdSport, Inc., 389 East Palm Lane, Phoenix, AZ 85004 (the “Administrator”) 4. Timing: The Sweepstakes begins at 12:00:01 AM Mountain Time (MT) on December 31, 2011 and ends at 11:59:59 PM Mountain Time (MT) on March 31, 2012 (the “Sweepstakes Period”). Administrator is the official time keeper for this Sweepstakes. 5. Prizes: Sponsor shall award the following Sweepstakes Prizes (the “Prize” / “Prizes”):
Approximate Retail Value of All six (6) Prizes: Three Thousand Three Hundred Ninety-Nine Dollars ($3,399.00). Prizes are nontransferable. No cash equivalent and no substitution will be made except as provided herein in Sponsor’s sole discretion. Sponsor reserves the right to substitute any listed Prize for one of equal or greater value if the designated Prize should become unavailable for any reason. Sponsor reserves the right to select an alternate location and/or service provider for all Prizes if the service provider chosen by the Winner should be deemed unacceptable by the Sponsor for any reason. Winners are responsible for all taxes and fees associated with Prize receipt and/or use. NO OTHER EXPENSES OTHER THAN AS SET FORTH HEREIN SHALL BE PROVIDED. 6. Odds of Winning: Odds of winning depend on the number of eligible entries received during the Sweepstakes Period. Each participant will be limited to submitting one entry only. Notwithstanding the foregoing, in the event a participant takes part in the “Refer a Friend” program, such participant is eligible to receive one additional entry into the Sweepstakes (for the same Prize they initially selected) for each “Referred Friend” who consequently participates in the Sweepstakes (regardless of what Prize the Referred Friend selects). Participation in the Refer a Friend program is performed as follows: [1] A participant fills out a Refer a Friend form (form is available after completing the Sweepstakes registration form located at facebook.com/SFTCS and SFTCS-FB.com) with the name and valid email addresses of up to Five (5) people who are eligible (must be an Arizona, Colorado, Nevada, Utah, or Wyoming resident and 18 years old at the time of entry) to participate in the Sweepstakes. [2] If the Referred Friend thereafter registers for the Sweepstakes, all participants who submitted a Refer a Friend form with the name and valid e-mail address of that Referred Friend will automatically receive one additional Sweepstakes entry (therefore increasing their odds of winning). To refer a friend and receive an additional entry, the email address of the Referred Friend who participates in the Sweepstakes must exactly match the name of the referred person as indicated on the participant’s Refer a Friend form. Each participant may refer up to five friends, but may not refer the same friend twice. A Referred Friend may also refer others and receive additional Sweepstakes entries. ALL PARTICIPANTS SHOULD BE SURE TO OBTAIN THE CONSENT OF THE PERSON OF WHOM THEY PLAN TO REFER. BY PARTICIPATING IN THIS SWEEPSTAKES, EACH PARTICIPANT HEREBY INDEMNIFIES (AND HOLDS HARMLESS) STATE FARM AND ITS “RELEASED PARTIES” (AS DEFINED IN PARAGRAPH 11) FROM ANY AND ALL LIABILITY (INCLUDING REASONABLE ATTORNEY’S FEES) INCURRED DUE TO A PARTICIPANT SUBMITTING A NAME AND/OR EMAIL ADDRESS WITHOUT PERMISSION. 7. How to Enter: [1] Beginning at 12:00:01 AM Mountain Time (MT) on 12/31/11, consumers may participate in the Sweepstakes by visiting www.facebook.com/SFTCS or SFTCS-FB.com (the “Site”), fully completing and submitting the Registration Form (registration is free), and selecting the Prize they would like to be entered to win from the Prize list provided, to receive one (1) entry for the applicable Entry Period (as defined in Paragraph 4). An individual may select only one (1) of the six (6) Prizes at the time of entry, may not enter to win any of the other five (5) Prizes, and may not change their Prize selection once registration has been completed. In the event a participant enters the Sweepstakes more than once, their first Prize selection shall be the official Prize selection regardless of subsequent entries. Selection of a Prize and/or information on Registration Form cannot be changed after initial selection and/or completion. Selection of a Prize can affect a consumer’s odds of winning based upon the number of entries for that Prize (as described in Paragraph 6). Online entries must be submitted by 11:59:59 PM (MT) on 03/31/12. Limit one entry per person or email address (excluding Refer a Friend entries). In the event of a dispute as to who submitted an online entry, the entry will be assumed to have been submitted by the holder of the e-mail address submitted at the time of entry. Sponsor is not liable for late or misdirected entries. NO PURCHASE NECESSARY TO ENTER OR WIN. [2] During the Sweepstakes Period, participants may enter by filling out a standard 3″ x 5″ card with the date, legal name, address, phone number, date of birth, e-mail address, mobile number (or alternate phone number), and choice of Prize, and mail the card to “The get to a better STATE™ Sweepstakes” c/o AdSport, 389 East Palm Lane, Phoenix, Arizona 85004. All mailed-in entries must be postmarked by March 31, 2012 and received by April 6, 2012 at 5:00pm (PST). Mailed-in entries must be handwritten and cannot be photocopied, printed by machine, computer printed or otherwise mechanically reproduced. Sponsor is not responsible for lost, late, delayed, damaged, stolen, illegible, incomplete, mutilated, misdirected entries or postage due entries or mail. Proof of mailing does not constitute proof of delivery. Up to six (6) mail-in entries are permitted per person. Entries become property of Sponsor and will not be acknowledged or returned. Limit: Each participant may enter online only once during the Sweepstakes Period (but may receive five additional entries through the Refer a Friend program, or by using the mail-in method of entry). Single participants are not permitted to share the same email address. Any attempt by any participant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations, or any other methods will void that participant’s entries and that participant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the “Authorized Account Holder” of the email address used to register will be deemed to be the registrant or player. The Authorized Account Holder is the natural person assigned an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted address. Winners may be required to show proof of being the authorized account holder. 8. Random Drawing: A random drawing (the “Drawing”) will be made for each of the (6) six Prizes from all eligible entries received for that Prize. The random drawings will be conducted on or about April 6, 2012 by the Administrator, whose decisions are final, binding, and conclusive in all matters relating to the Sweepstakes. The Drawing will be conducted at a location to be determined by the Administrator. 9. ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION PROCEDURES BY SPONSOR AND/OR ADMINISTRATOR. AN ENTRANT IS NOT A WINNER OF ANY PRIZE, UNLESS AND UNTIL ENTRANT’S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR WILL NOT ACCEPT SCREEN SHOTS OR OTHER EVIDENCE OF ENTRY IN LIEU OF ITS VALIDATION PROCESS. ANY ENTRY THAT OCCURS AFTER THE SYSTEM HAS FAILED FOR ANY REASON IS DEEMED A DEFECTIVE ENTRY AND IS VOID AND WILL NOT BE DEEMED AN ACCEPTABLE ENTRY. 10. Verification of Potential Winner: All entrants must comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. The potential Winner will be notified by email, telephone, or registered mail after the date of the random drawing. The potential Winner will be required to sign and return to Administrator within two (2) business days of the date notice is sent, an affidavit of eligibility and liability/publicity release (except where prohibited) in order to claim his/her Prize. If a potential Winner of any Prize cannot be contacted, or fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period, potential winner will forfeit Prize. In the event that a potential Winner is disqualified for any reason, Sponsor will award the Prize to an alternate winner by random drawing from among all remaining eligible entries. There will be up to three (3) alternate drawings after which any remaining Prizes will remain un-awarded. Winner must take delivery of Prizes as designated by Sponsor at its discretion. If any of the herein noted requirements are not met, the Prize will be forfeited and may be awarded to an alternate. Winner is solely responsible for any license and or registration requirements. 11. Release: By entering and agreeing to the Official Rules, all entrants agree to release and hold harmless Facebook Inc., Sponsor, Administrator and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies and each of their respective parent companies and each such company’s officers, directors, employees, and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of any Prize. 12. Publicity: Except where prohibited, participation in the Sweepstakes constitutes winner’s consent to Sponsor’s and State Farm independent contractor insurance and financial services agents use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration. 13. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. The Sponsor has neither made, nor is in any manner responsible or liable for, any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any Prize, regarding the use, value or enjoyment of the Prize, including, without limitation, its quality, mechanical condition or fitness for a particular purpose. 14. Limitations of Liability: The Released Parties are not responsible for: [1] any incorrect or inaccurate information, whether caused by entrants, or by any of the equipment or programming associated with or utilized in the Sweepstakes; [2] technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; [3] unauthorized human intervention in any part of the entry process or the Sweepstakes; [4] technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or [5] any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any Prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes, provided that if it is not possible to award another entry due to discontinuance of the Sweepstakes, or any part of it, for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the Prizes offered herein. No more than the stated number of Prizes will be awarded. In event that production, technical, seeding, programming or any other reasons cause more than stated number of Prizes as set forth in these Official Rules to be available and/or claimed Sponsor reserves the right to award only the stated number of Prizes by a random drawing among all legitimate, un-awarded, eligible Prize claims. By participating in this Sweepstakes, entrants hereby agree to release and hold Sponsor, Administrator, harmless from and against all losses, damages, liabilities, claims, actions, proceedings, or judgments arising out of or relating to entrant’s entry or participation in this Sweepstakes or use or misuse or any Prizes awarded hereunder. 15. Disputes: Except where prohibited, entrant agrees that: [1] any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively in accordance with the laws of the State of Arizona, without regard to its choice of law rules. The Parties hereto consent to the jurisdiction and venue of the federal, state and local courts located in Maricopa County, Arizona; [2] any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and [3] under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Arizona, without giving effect to any choice of law or conflict of law rules (whether of the State of Arizona or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Arizona. 16.
